PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD

There is hereby established a board to be known as the Protection
of

The Board shall consist of a Chairman appointed under the Schedule

PART IV FINANCIAL PROVISIONS

PART V PAYMENT FROM THE FUND
Entitlement to apply for ex gratia payment
Subject to this Part, an applicant to whom--
wages are due and unpaid;

Payment
Subject to subsections (1B) and (2) where it appears

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner
on an

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

the employer employs less than 20 employees;
sufficient evidence exists to support the presentation of a
petition

if the employer is a company, that he is unable to pay his debts;
or
if the employer is a person other than a company, that

case.
Where the Commissioner exercises his discretion under
subsection (1)
ake payment, he shall give notice in the Gazette stating that,
in his

if the employer is a company, that he is unable to pay his debts;

if the employer is a person other than a company, that

Nothing in subsection (2) shall require the Commissioner to give

Verification of application
For the purpose of verifying any application under section 15,
or if
equired by the Board under section 17 (3), the Commissioner may

河南省关于土地违法案件移送司法机关查处的暂行规定
河南省土地管理局 省人民检察院
第一条 为了贯彻落实土地基本国策和依法治省的精神,加强土地执法力度,根据《中华人民共和国行政处罚法》第二十二条,制定本规定。
第二条 本规定依据《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》、《全国人大常委会关于惩治偷税、抗税犯罪的补充规定》、《中华人民共和国土地管理法》等有关规定设定移送案件。
第三条 本规定适用于本省行政区域内国家工作人员因玩忽职守造成土地违法事实或徇私舞弊、打击报复的行为;土地使用者偷税行为;妨害土地执法人员依法执行职务的行为。
第四条 土地违法行为,凡达到人民检察院或公安机关刑事案件立案标准的,土地管理部门应将案件移送人民检察院或公安机关查处。
第五条 土地管理部门移送案件,应做到调查充分,证据确凿,事实清楚,定性准确,并制作《土地违法案件移送书》。
《土地违法案件移送书》包括以下内容:
(一)单位、姓名等概况;
(二)违法事实和适用法律;
(三)处理建议。
第六条 人民检察院或公安机关查处的有关土地违法案件,需要土地管理部门配合时,土地管理部门应积极配合。
第七条 土地管理部门移送人民检察院或公安机关查处的案件,人民检察院或公安机关应将处理情况反馈土地管理部门。
对不追究刑事责任而应追究行政责任的案件,人民检察院或公安机关应将案件移送行政监察机关。
第八条 涉及县级以上领导干部的土地违法案件,由上一级土地管理部门移送同级人民检察院或公安机关。
第九条 省土地管理局受理的案件可直接移送省人民检察院或省公安厅,省人民检察院或省公安厅可指定下级机关立案查处或直接立案查处。
根据需要,上级土地管理部门可直接查处下级土地管理部门管辖的案件,也可把自己受理的案件指定下级土地管理部门查处。
下级土地管理部门对自己查处有困难的案件可报请上一级土地管理部门查处。
第十条 国家工作人员玩忽职守,造成土地违法事实,给国家、集体和个人造成直接经济损失5万元以上;或死亡1人以上、重伤3人以上;或造成严重政治影响;或者虽不足上述标准,但情节特别严重的,应对直接责任人或主管人员追究刑事责任。
前款直接经济损失按以下项目计算:
(一)耕地的年产值;
(二)政府应当依法收取的土地使用权出让金等土地收益;
(三)单位或个人合法收入的有关土地补偿费等费用;
(四)因违法用地盲目投资建设或终止建设造成的直接经济亏损;
(五)其它方面。
前款特别严重的标准为非法批准和未经批准占用耕地50亩以上,其它土地100亩以上;其它特别严重情节参照有关规定根据实际情况确定。
第十一条 有下列违法行为之一,并符合第十条规定的,土地管理部门应将案件移送人民检察院:
(一)无权批准而擅自批准用地;
(二)越权批准土地;
(三)化整为零批准土地,并使批准总面积越权;
(四)未经依法办理用地手续,任意批准建设单位实施违法占地;
(五)擅自批准减免土地使用权出让金或有关土地税费。
第十二条 国家工作人员徇私舞弊、对土地违法行为包庇纵容情节严重,致使土地违法行为得不到查处,土地管理部门应将案件移送人民检察院。
第十三条 国家工作人员对土地执法人员打击报复情节严重的,由上一级土地管理部门向同级人民检察院报案,由人民检察院查处。
第十四条 土地管理部门对下列行为应及时向公安机关报案,由公安机关立案查处:
(一)以暴力、威胁的方法,阻碍土地执法人员依法执行职务的;
(二)故意伤害土地执法人员身体,造成重伤、死亡的;
(三)土地使用者不依法办理用地手续,逃避缴纳耕地占用税、土地使用税、土地增值税和营业税,其数额占应纳税额百分之十以上并且偷税数额在一万元以上的。
第十五条 未使用暴力、威胁的方法,拒绝、阻碍土地执法人员依法执行职务的,土地管理部门应向公安机关报案,由公安机关依照《治安管理处罚条例》处罚。
第十六条 国家有关规定因修改或增设与本规定不一致时,按新规定执行。
第十七条 本规定在应用中的有关问题,由联合发文部门按照各自的职能分工分别解释。
第十八条 本规定自1997年元月1日起执行。
